The owners of New York’s Empire State Building have sued a photographer for shooting images of a topless model on the building’s observation deck. Allen Henson is being sued for $1.1 million in the New York Supreme Court over the photographs he took of model Shelby Carter.
“At the time the model entered, the observatory was crowded with visitors, including children,” a lawyer for the Empire State Building said in the lawsuit. The documents filed also state that the incident threatened the companies’ ability to ensure a “safe, secure and appropriate place for families and tourists”.
Henson claims that the photos have no commercial value and were taken of a friend with his personal mobile phone. He told USA today that he was annoyed at the owners’ claims that he took the photos for what they called his “self-styled ‘boobs around town project’.”
“It wasn’t a photoshoot - I don’t think anyone even noticed really,” the photographer said.
